Up in Smoke
Landmark Smokers' Trial Could Hit a Record Verdict
Associated Press

The tobacco industry intentionally ruined millions of lives but keeps
stonewalling to delay any financial consequences, a smokers' attorney
said Monday in a final request for punitive damages. "This industry has
left a half-century trail of deceit which has decimated millions of
Americans," Stanley Rosenblatt said as closing arguments started for
punitive damages began in the landmark, 2-year-old case. "Never have so
few caused so much harm to so many for so long, and the day of reckoning
has arrived." Each side has two days to summarize the landmark
class-action case on behalf of 300,000 to 700,000 sick Florida smokers.

U.S. Lawyers Split on Partnerships with Nonlawyers

The American Bar Association is gearing up to tackle one of the legal
profession's most divisive issues: whether to end a ban on partnerships
between lawyers and such nonlawyers as accountants and financial
planners.

Discovering the Possibilities
Discover Card Chief Testifies In Visa-MasterCard Antitrust Trial
Dow Jones

The president of Discover cards testified in the federal antitrust trial
against MasterCard and Visa that consumers and merchants could benefit
from lower prices if banks could issue credit cards on the Discover
network - a key point in the Justice Department's case. Still, David
Nelms, president of Discover Financial Services, a unit of Morgan
Stanley Dean Witter & Co. (MWD), wasn't the ideal government witness.
He also said the government's proposed remedy in the case could actually
hurt rather than help Discover, a small player in the $1.3-trillion U.S.
credit card market, and that he would prefer a much broader shake-up of
the U.S. credit-card industry.

Women Will Wait
New York Restaurants Abandon Male-Only Tradition
Reuters

The prominent Cipriani restaurant family has agreed to settle a closely
watched bias lawsuit by hiring women servers, breaking a tradition among
some fancy restaurants of hiring only males, New York's attorney general
said Thursday. The suit was being followed by upscale restaurateurs --
including those who run steakhouses and French and Italian
establishments -- who believe luxury service requires an all-male wait
staff.

Stalking Spam?
Stalkers Find a New Tool
SF Gate

For more than two years, Ann Terranova, a 43-year-old San Francisco
woman, was inundated by a blizzard of e-mail messages that threatened
her life and those of her two children. Terranova is one of a growing
number of victims of a crime that state and federal law enforcement
personnel have called ``cyberstalking'': the use of the Internet, e-mail
or other electronic communications to repeatedly threaten or harass
another person. And she is not alone.

"We Know Larceny and This is Larceny!"
Inmates Sue Over High Phone Costs
Associated Press

Inmates in seven states are suing over the high cost of making phone
calls from prison. They are challenging the deals under which a state
or county government gets as much as 60 cents on the dollar from a
telephone company that is given exclusive rights to handle all calls
from behind bars.

A Sign of the !@#$% Times
Bar Owner Wins Profanity Case
Denver Post

Leonard Carlo is f------ happy. Carlo is the unabashedly foul-mouthed
Colorado Springs bar owner who 10 months ago watched a Colorado liquor
enforcement agent come into his place "like a German storm trooper" and
confiscate 29 profane signs under a regulation that in part prohibits
profanity in bars. On Thursday, Carlo was in a much happier frame of
mind because the state has agreed not to enforce the profanity part of
the regulation.
